Scholar Explains Limits of Free Speech in Nigeria Amid Soowore–Tinubu Row

A phonologist and sociolinguistics scholar at Kwara State University, Dr. Mariam Olugbodi has weighed in on the controversy surrounding activist Omoyele Sowore’s recent remarks describing President Bola Tinubu as a “criminal.”

Speaking on Adamimogo 105.1 FM Ibadan’s current affairs programme Inside Scoop on Monday, Olugbodi explained that while the Nigerian Constitution guarantees freedom of speech under Section 39, it also places restrictions under Section 45, particularly on grounds of public safety and morality.

She argued that Sowore’s comments did not amount to a threat to public safety but fell short of moral responsibility. “From the perspective of morality, he was out of line. He could have expressed his opinion differently, in a way that would still be constitutionally protected but more ethically justifiable,” she said.

Olugbodi highlighted the importance of “hedging” in language use, urging public figures to be mindful of words that may incite tension. “Naming can be face-threatening. He could have made his point without directly labeling the president,” she noted.

On the Federal Capital Territory Minister Nyesom Wike’s position that Sowore was “lucky” to have a president tolerant of criticism, Olugbodi responded that tolerance is a non-negotiable trait of leadership. “A leader must be tolerant, whether or not they like the criticism. That is part of serving the people,” she added.

She also pointed out that the public perception of Showore’s statement is amplified by his status. “If it were an ordinary Nigerian making such a comment, it might not have attracted the same level of attention. His position in society makes it significant,” she explained.

However, Olugbodi advised politicians to treat social media remarks, whether from elites or ordinary citizens with caution and maturity.

“Social media is a chaotic space where all kinds of things are said. Leaders should focus on leading by example and be mindful of language, rather than overreacting to every provocation,” she said.
